The Economic Development Agency for the City of Madrid-Agencia de Desarrollo Económico de la Ciudad de Madrid (Henceforth Madrid Emprende or the Agency), in collaboration with Madrid City Council, places the Madrid Emprende portal at the disposal of all local companies, citizens and visitors under the terms specified in the following conditions:
 
First.- User definition.
 
Users are all those who access and/or use esmadrid.com, and who accept the following General Conditions with immediate effect, without reservation, and without prejudice to Particular Conditions that the Agency may establish for the regulation of certain services and/or contents. In the case of minors, permission must be sought from parents, teachers, or legal guardians, who will be considered responsible for all effects resulting from all acts carried out by minors in their charge. 
 
Second.- User obligations.
 
Users are obliged to use the website of Madrid Emprende in compliance with existing legislation, exercising good faith, respecting public order and generally accepted customs and standards.

Likewise, users of the website of Madrid Emprende must not use the portal for illicit purposes or to damage the rights and/or interests of the Agency, Madrid City Council and/or third parties, or to damage the portal or otherwise prevent its correct functioning.
 
Third.- Users' responsibility.
 
Users accept sole responsibility for their use of the website of Madrid Emprende. Under no circumstances will the Agency and/or Madrid City Council accept responsibility for any direct or indirect damage caused to users or third parties due to failure of the former to adhere to the present General Conditions on use of the portal.

Furthermore, the Agency reserves the right to deny access to and/or use of the website of Madrid Emprende, or any of the contents and/or services thereof, to any user who fails to comply with these General Conditions.
 
Fourth.- Responsibility of Madrid Emprende.
 
The Agency shall not be held responsible for any type of damages suffered by users or third parties deriving from: (i) lack of availability, maintenance or effective functioning of the website of Madrid Emprende, its services or its contents; (ii) failure of esmadrid.com or its services or contents to satisfy user expectations or requirements in terms of lack of usefulness, veracity, adequacy or validity; (iii) intrusive use of the website of Madrid Emprende or its contents or services to transmit viruses or gain unauthorised access to data stored by Madrid Emprende; (iv) or, in general, for any use of the website of Madrid Emprende, its services and/or contents by users or third parties, which contravenes the conditions for access and use of the same as established by the Agency.
 
Fifth.- Authorisation of use of contents.
 
Contents which Promoción Madrid places at the disposal of users are protected by relevant intellectual property laws, permission having been obtained from owners of said rights. 

The Agency authorizes use of the website content of Madrid Emprende for purposes for which it is intended or those covered by the present General Conditions. Any reproduction, distribution, modification or public communication of the same, or part thereof, without express permission, or which does not comply with legislation in force, is expressly prohibited.

Sixth.- Authorization of use of brands and logos.
 
The Agency and/or Madrid City Council are sole owners of all industrial property rights related to the brands and logos used in relation to the website of Madrid Emprende, and any use or reproduction of the same not expressly covered in the present General Conditions is expressly forbidden.

Seventh.- Links.
 
Links provided by the Agency to users have the sole purpose of facilitating access to other contents and/or services which may be of interest to them. These are not administered or controlled by Madrid Emprende.

The Agency shall not be held responsible, whether directly or indirectly, for the legality, accuracy, usefulness, quality or trustworthiness of contents and/or services not directly administered or controlled by Promoción Madrid, regardless of the fact that these may be accessed via the website of Madrid Emprende.
 
Eighth.- Management of personal data.
 
Madrid Emprende has a Privacy Policy regulating the storage, management and use of personal data facilitated by the user to the Agency. Furthermore, Madrid Emprende guarantees its own compliance with this policy, which may be consulted via the Privacy Policy link at the bottom of the page on the website of Madrid Emprende.

Ninth.- Modification and cancellation of these Conditions.
 
The Agency reserves the right to totally or partially modify the website of Madrid Emprende, its design, contents and/or services, as well as these Conditions, as it sees fit.

Likewise, the Agency reserves the right to interrupt, temporarily postpone or definitively cancel the website of Madrid Emprende, or any of the contents and/or services included, as it sees fit.
 
Tenth.- Applicable legislation and conflict resolution.
 
The parties, expressly renouncing any other jurisdiction, accept that the present Conditions are governed by Spanish law, and, furthermore, that any controversy or litigation relating to them will be resolved in the Madrid City Law Courts.
